Palm Beach County Ordinance 94-16 establishes a countywide juvenile curfew that applies in Delray Beach. Minors under 17 are prohibited from public places from 11 PM to 5 AM Sunday through Thursday, and midnight to 5 AM Friday and Saturday, with limited exceptions.
The Palm Beach County juvenile curfew is codified in PBC Code §17-51 et seq. and applies to all incorporated and unincorporated areas including Delray Beach. Prohibited hours are 11 PM to 5 AM on Sunday through Thursday and 12 AM to 5 AM on Friday and Saturday. Exceptions include: accompanied by parent or guardian, traveling to or from work, responding to an emergency, attending a school or religious function, exercising First Amendment rights, or on an errand directed by a parent. Parents or guardians who knowingly allow curfew violations can also be cited. Delray Beach Police enforce the curfew within city limits. Repeat offenders may be referred to Juvenile Assessment Center.
First offense typically results in a warning and parent notification. Subsequent violations are noncriminal infractions with fines up to 500 dollars on the parent or guardian.
