Gaithersburg enforces a juvenile curfew that restricts minors from being in public places during late-night hours without a parent or guardian. The curfew applies to minors under 18 on school nights and weekends with different hour restrictions. Exceptions exist for minors traveling to or from work, school events, or emergencies. Parents may be cited for allowing curfew violations.
The Gaithersburg Code of Ordinances establishes a juvenile curfew to promote public safety and reduce juvenile crime. Minors under the age of 18 are prohibited from being on public streets, in parks, or in other public places during curfew hours without a parent, guardian, or other authorized adult. Sunday through Thursday, curfew begins at 11 PM and ends at 5 AM. Friday and Saturday, curfew begins at midnight and ends at 5 AM. Exceptions to the curfew include minors accompanied by a parent or guardian, minors traveling directly to or from a place of employment, minors attending or returning from a school-sanctioned activity, religious event, or civic function, minors engaged in interstate travel, and minors responding to an emergency. The curfew is enforced by the Gaithersburg police. Officers who encounter a minor in violation will typically attempt to contact the parent or guardian and arrange for the minor to be taken home. Repeated violations may result in fines assessed against the minor or the parent. Parents who knowingly allow their minor child to violate curfew may face separate citations. Montgomery County also has curfew provisions that apply in unincorporated areas. Contact the Gaithersburg Police at 301-258-6400 for questions.
First-time curfew violations typically result in a warning and contact with the parent or guardian. Repeat violations may result in fines assessed against the minor or parent. Parents who knowingly permit curfew violations may face separate citations. Persistent violations may be referred to the juvenile justice system.
