Full Breakdown
The Fiscal Court's curfew subchapter defines a MINOR as any person under the age of 18, or any person of the age of 17 or under unless emancipated by marriage or service with the armed forces of the United States. Section 130.16 makes it unlawful for a minor to be or remain in or upon any public assembly, building, place, street or highway within the county during these periods: 1:00 a.m. to 6:00 a.m. Saturday; 1:00 a.m. to 6:00 a.m. Sunday; 11:00 p.m. Sunday to 6:00 a.m. Monday; 11:00 p.m. Monday to 6:00 a.m. Tuesday; 11:00 p.m. Tuesday to 6:00 a.m. Wednesday; 11:00 p.m. Wednesday to 6:00 a.m. Thursday; and 11:00 p.m. Thursday to 6:00 a.m. Friday. REMAIN means to stay behind, to tarry, or to stay unnecessarily.
The duty also falls on the adult. Section 130.17 makes it unlawful for a custodian with legal custody of a minor to allow the minor to be or remain in those places during curfew. ALLOW means to permit or neglect to prevent, which takes actual or constructive knowledge: the custodian actually knew, or a reasonably prudent custodian should have known.
Section 130.18 lists ten exceptions. A minor is not in violation when accompanied by a custodian or by an adult the custodian has authorized; when exercising First Amendment rights, with written notice signed by the minor and countersigned by a custodian stating when, where and how; in reasonable necessity, after the custodian has told the police department the facts; on the sidewalk of the minor's own residence or of a next-door neighbor who has not objected; when returning home by a direct route within one hour of the end of a school activity, an activity of a religious or other voluntary association, or work; under a regulation of the Judge Executive for events involving many minors, which cannot extend more than one hour past the activity; when working at a job Kentucky law authorizes a minor to perform; when riding with the custodian's consent in a motor vehicle with a lawfully authorized driver; or when a licensed minor driver is passing through the county by a direct route.
Under § 130.19 a police officer can stop and question a minor, ask for name, age and the custodian's name and address, obtain the information needed to cite the custodian, and then take the minor home or direct the minor to go home immediately.
Violations & Fines
Section 130.99(A) puts the penalty on the adult: any custodian allowing a minor to violate §§ 130.15 through 130.19 is subject to a fine of not more than $500 for each violation or imprisonment for a period not to exceed 6 months. The citation under § 130.19 is issued to the minor's custodian.
