Miami-Dade County Code Β§21-282 establishes the juvenile curfew applicable within the City of Miami and most of the county. It is unlawful for any minor under 17 to remain in any public place during curfew hours: 11:00 PM to 6:00 AM Sunday through Thursday, and 12:01 AM to 6:00 AM Saturday and Sunday. Miami Beach and other entertainment districts have periodically imposed stricter zone-specific curfews (e.g., midnight in South Beach during spring break states of emergency).
Defenses include parental accompaniment, parental errands, employment travel, attending school or religious activity, emergency response, emancipation, First Amendment exercise, and interstate travel. Officers transport detained minors to an assessment center or to a parent.
Violations are civil infractions with graduated fines: $50 first offense, $100 second, $500 subsequent within a year. Parents who knowingly permit a violation can be cited. Minors are typically routed to the Juvenile Assessment Center for diversion.
