Texas prohibits juvenile curfews. Local Government Code section 370.008 bars any city or county from adopting or enforcing a curfew on anyone under 18, so no Texas municipality has an enforceable juvenile curfew.
House Bill 1819, effective September 2023, ended municipal juvenile curfews across Texas. Local Government Code section 370.008, titled Juvenile Curfews Prohibited, bars a political subdivision from adopting or enforcing a curfew that applies to anyone under 18. The same bill repealed the provisions that had authorised those ordinances and required their periodic renewal, so there is no longer a mechanism to bring one back. The one exception is an emergency management curfew declared under Government Code chapter 418, which applies to everyone rather than to minors. Some city codes still print an expired curfew section because no housekeeping repeal was passed.
There is no juvenile curfew to violate. A citation issued to a minor under a local curfew ordinance would be unenforceable, because state law bars the ordinance itself.
