Full Breakdown
Division 2 of Article VIII (Offenses Affecting Underage Persons) in Chapter 16 of the Charter Township of Royal Oak Code sets the minors' curfew, adopted as Ord. No. 62 on 11-18-2004. Section 16-256 makes it unlawful for any minor under the age of 17 years to loiter, idle, wander, stroll, frequent, travel in or upon a motor vehicle, or otherwise be or remain in or upon public sidewalks, streets, alleys, parks, public buildings, places of amusement or entertainment or other public grounds or places in the township between 10:00 p.m. and 6:00 a.m.
Section 16-257 lists eight exceptions. The minor is accompanied by a parent, guardian or a caretaker 21 years of age or older who is authorized by a parent; on an errand at a parent's direction without detour or stop; in a vehicle involved in interstate travel; working, or going to or from work, without detour or stop; involved in an emergency; on the sidewalk that abuts the minor's or the next-door neighbor's residence, if the neighbor has not complained to the police; attending an official school, religious or other recreational activity sponsored by the township, a civic organization or a similar entity that takes responsibility for the minor, or going to or from it, supervised by adults; or exercising First Amendment rights, including free exercise of religion, freedom of speech and the right of assembly.
Adults are covered too. Section 16-258 makes it unlawful for a parent, guardian, custodian or other person with legal care and custody of a minor under 17 to allow the minor to violate the division unless an exception applies, and it bars any person from assisting, aiding, abetting or encouraging a violation. Township parks also have their own dusk-to-dawn rule in § 17-35, which applies to every person and not only minors, unless other hours are posted or a special permit has been given.
Violations & Fines
Section 16-259(a) treats a violation as a municipal civil infraction, with a civil fine as prescribed by ordinance or set by the district court. The court must order costs of not less than $100.00 or more than $500.00. A defendant who fails to answer a citation or notice to appear is guilty of a misdemeanor, punishable by a fine of not more than $500.00 plus costs and/or imprisonment not exceeding 90 days. Unpaid fines can lead to civil contempt, with imprisonment not to exceed one day for each $30.00 due.
