The Council's stated findings behind Sec. 335, recorded at Sec. 334, cite a rise in truancy, juvenile crime, victimization and gang activity during school hours before the daytime curfew, and a documented drop in incidents during the 1997-1998 school year when it was first in effect. Enforcement runs through Sec. 350: an officer who takes a minor into charge must notify the parent or guardian, and may instead release a daytime violator to a school principal or designated official.
Sec. 340 separately makes it unlawful for a parent, guardian or custodian to knowingly allow a minor to violate either curfew, and Sec. 360 makes it a separate offense for that adult to refuse to come pick up the minor once notified by police.

Curfew violations by a minor, and a parent's or guardian's knowing allowance of a violation under Sec. 95.340, default to the citywide general penalty at Sec. 1.070 since Chapter 95's curfew sections state no separate fine: up to six months in jail and/or a $500.00 fine for a misdemeanor-level offense. A parent's refusal to retrieve a detained minor under Sec. 95.360 is charged as a separate offense from the underlying curfew violation.
