Full Breakdown
Washington County Code Chapter 9.08, adopted under authority the board finds in ORS 419.740, bars an unemancipated minor from being on any street, highway, park, alley or other public place during curfew hours defined in Section 9.08.060, unless accompanied by a parent, guardian, or other person 21 or older with lawful custody, or unless the minor is traveling to or from school activity or lawful employment (Section 9.08.040). The curfew clock, per 9.08.060, runs from 9:15 p.m. to 6 a.m. for minors under 14 during the September-through-May school year (extended to 10:15 p.m. the night before a non-school day), and from 10:15 p.m. to 6 a.m. for minors under 14 during June through August.
For minors 14 and older, the window is 10:15 p.m. to 6 a.m. during the school year (extended to 11:59 p.m. the night before a non-school day) and 11:59 p.m. to 6 a.m. during summer. The curfew doesn't apply to a minor emancipated under ORS 109.550 to 109.565 (Section 9.08.050). Section 9.08.070 separately makes it unlawful for a parent to allow or fail to prohibit a minor's violation, and Section 9.08.090 lets an officer take a violating minor into temporary custody under ORS 419.760. Newspaper carriers under 18 need an employer-issued employment card documenting the job under Section 9.08.080. This chapter governs the unincorporated area; Hillsboro and Beaverton enforce their own curfew ordinances within city limits.
Violations & Fines
Any violation of Sections 9.08.040 through 9.08.090 is punishable by a fine of not more than $500 under Section 9.08.110; the same section caps any combined fine/jail penalty at no more than $500 or six months, and states no greater penalty may be imposed than Oregon statute allows for the same offense. A violating minor may be taken into temporary custody under ORS 419.760, and a parent who knowingly allows the violation is separately liable under Section 9.08.070.
