Rutherford County, NC Curfew Laws: Park Curfew (2026)

Article III of Chapter 13 sets the operating rules for the Thermal Belt Rail Trail, the county's flagship recreational corridor connecting Rutherfordton, Spindale and Forest City. Section 13-36, adopted May 6, 2019, states the hours in a single sentence: the trail "shall remain open from dawn until dusk," with no exception listed for special events or maintenance access by the public. The same article layers safety and conduct rules onto those hours: section 13-37 sets a 15 mph speed limit and requires stopping at every street crossing, and section 13-39 bars hunting, firearms without a lawful concealed-carry permit, horses, most motorized vehicles, loitering, and unapproved signage on the corridor.

The recreation commission created under section 13-16, a nine-member board appointed by the board of commissioners, advises on maintenance and operation of the county's parks, playgrounds and recreation facilities, including the trail, but the hours themselves are fixed by ordinance rather than left to the commission's discretion. Because Article III carries no penalty clause of its own, enforcement of the dawn-to-dusk limit and the other trail rules falls back on the county's general penalty provision at section 1-11, which the code applies whenever a specific chapter is silent on punishment.
