Under Yuba County Code 8.76.030, it is unlawful to enter or remain in a county park from no later than 30 minutes after sunset until no earlier than 30 minutes before sunrise, except authorized personnel. Overnight camping or sleeping needs a permit. A violation is a misdemeanor punishable by up to six months in jail and/or a $1,000 fine.
Park hours in unincorporated Yuba County are set by County Code Chapter 8.76 (Parks and Recreation Areas), in Title VIII (Public Peace, Safety and Welfare) - not the zoning Development Code. Section 8.76.030 (Hours) provides that 'it shall be unlawful for any person to enter or remain upon the premises of any park or recreation area... within the period of: (1) No later than 30 minutes after sunset and; (2) No earlier than 30 minutes prior to sunrise,' with an exception for authorized personnel. In effect, parks are closed from 30 minutes after sunset to 30 minutes before sunrise. The chapter separately prohibits overnight use without authorization: Section 8.76.050 makes it unlawful to 'camp or sleep overnight either in a vehicle or otherwise without a permit,' and daily limits and hours for any permitted overnight camping are set by Board of Supervisors resolution. Hammon Grove Park and Sycamore Ranch Park are governed separately under Chapter 8.79. The chapter applies to parks and recreation areas controlled by the County and the Olivehurst Public Utility District (OPUD). It was adopted by Ordinance No. 1498 (September 21, 2010).
Section 8.76.110 provides that any person violating any provision of the chapter 'is guilty of a misdemeanor, and... is punishable by imprisonment in the County Jail for a term not exceeding six months or a fine not exceeding $1,000.00 or both.' Each separate day of violation is a separate offense. Entering or remaining in a park after hours, or camping/sleeping overnight without a permit, falls under this penalty.
