Summary

Delaware County bans flying drones, model aircraft, model vehicles and model boats in its parks except in areas the Parks and Recreation Department has designated for that use, or under a permit. These county ordinances apply to unincorporated areas of Delaware County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

No person shall engage in the use of drones, gas- or battery-powered model aviation devices, model motor vehicles, or boats, whether radio controlled or not, except at areas designated by the County Parks and Recreation Department or as authorized by permit.

Q. Sledding, skating and skiing. No person shall coast, tube, snowboard, sled or downhill ski except where, when and if there are places designated by the County Parks and Recreation Department. No person shall use in-line skates or roller skates except at places designated by the County Parks and Recreation Department. No person shall ice skate or go upon the ice except at such times and upon such places designated by the County Parks and Recreation Department.

R. Urinating or defecating. No person shall urinate or defecate except in facilities provided for such use.

S. Bicycles and nonmotorized vehicles. The County Parks and Recreation Department may establish restrictions on the use of bicycles and nonmotorized vehicles in specific areas of the parks.

T. Designation of nonsmoking areas. The Parks Board may, in its discretion, provide that smoking (including devices such as e-cigarettes and vaping) is prohibited in designated areas of the parks.

The ban lifts only in two circumstances: an area the County Parks and Recreation Department has specifically designated for that use, or with a permit the department has authorized. There is no general park-wide drone permit posted in the code; a flyer must contact the Parks and Recreation Department directly to find out whether a given park has a designated flying area or to apply for permit authorization, the same office that handles reservation permits under §141-2.
