State law also prohibits low-altitude drone flights over emergency response and wildfire scenes (CA Penal Code Β§402 and Government Code Β§853).
Flying a drone in a posted San Jose park without a permit is an infraction under SJMC Title 13 with citations, fines, and equipment seizure as evidence. Interfering with first responders is a separate misdemeanor under California Government Code Β§853.
