Beaufort County, SC Environmental Rules: Boat Dock Permits (2026)

190 (Water/Marine-Oriented Facilities) sets the standards for private and community docks in unincorporated Beaufort County. On small tidal creeks (defined as 100 meters or less in width, marsh bank to marsh bank), new subdivision lots need a minimum 250 feet of frontage to qualify for a private dock, unless the lot existed before May 8, 2000 or the subdivision uses a shared community dock instead. Dock length is capped at 300 feet total, counting pier-heads, floats, boatlifts, ramps, mooring and pilings; neighbors who combine lots into a community dock can earn a bonus of one extra foot of length for every foot of combined waterfront over 300 feet, up to a 500-foot ceiling.

Docks must stay within the extended property lines and at least 20 feet from extended side lot lines, though the Director can waive that setback for demonstrated unique circumstances if the waiver is the minimum necessary. Walkways and piers are capped at four feet wide unless a wider walkway is shown necessary for usability, and any safety railing must have slats at least two inches apart and stand no taller than three feet, with no walls blocking airflow. Boatlifts cannot raise a boat higher than 12 feet above mean high water.

Lighting must use shielded, downward-facing electrical cutoff fixtures. S. Army Corps of Engineers and the South Carolina Ocean and Coastal Resource Management Office (OCRM); all other docks still need OCRM sign-off. No plumbing beyond a sink or faucet is allowed, and toilets or sewage disposal on a dock are flatly prohibited. Dock use is limited to private, non-commercial purposes except within the Commercial Fishing Village Overlay District.
