Summary

Baltimore County requires a permit before any pier, dock, bulkhead, or mooring pile is built beyond mean low tide under BCZR Section 417. The Department of Permits, Approvals and Inspections reviews a plot diagram with every application, and the structure must fit within fixed divisional lines, size limits, and a public notice period before a permit is issued.

These county ordinances apply to unincorporated areas of Baltimore County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

All waterfront construction, such as piers, wharves, docks, bulkheads or other work extended into navigable waters beyond mean low tide as prescribed in Baltimore County Design Manual, shall be governed by these regulations as well as by § 33-2-801 of the Baltimore County Code, except that nothing in these regulations shall apply to the M.H. Zone and to the extension of industrial waterfront facilities to the limit of Corps of Engineers' established pierhead or bulkhead lines. ... No construction, beyond mean low tide, including mooring piles, will be permitted within ten feet of divisional lines as established. The effect of this requirement will be to maintain a 20-foot open access strip between the facilities of adjoining property owners. ... Any structure built beyond mean low tide must be contained within construction offsets as prescribed. In addition to meeting these requirements, the structure must not extend beyond any of the following limits: A. Three hundred feet beyond mean low tide. B. In the absence of a definable channel, not more than one-third the width of waterway. C. Not beyond the near boundary of a definable channel.

Under BCZR Section 503.1, violating any regulation or restriction adopted under the zoning ordinance is a misdemeanor punishable by a fine of up to $100, imprisonment of up to 30 days, or both, with each day a violation continues counted as a separate offense.

Frequently Asked Questions

Do I need a permit to build a dock in Baltimore County?
Yes. Any pier, wharf, dock, bulkhead, or other structure extended beyond mean low tide is governed by BCZR Section 417 and requires a permit application filed with the Building Engineer, including a plot diagram of the property and any proposed construction.
How close to my neighbor's property line can my pier extend?
No structure, including mooring piles, may be built within ten feet of the divisional line separating waterfront properties. That rule preserves a 20-foot open access strip between the waterfront facilities of adjoining owners under Section 417.4.
How far can my pier extend into the water?
Structures beyond mean low tide cannot exceed 300 feet. Where there is no definable channel, the limit is one-third of the waterway's width, and a structure can never cross the near boundary of a definable channel, per Section 417.5.
Can a neighbor object to my dock permit application?
Yes. Before a pier or mooring pile permit is granted, the property must be posted for 15 days, and any adjacent or directly affected owner can request a public hearing before an Administrative Law Judge under Section 417.9.
What happens if I build a dock without a permit?
Unpermitted waterfront construction violates the zoning regulations. Section 503.1 makes any violation of the zoning regulations a misdemeanor carrying a fine up to $100, imprisonment up to 30 days, or both, with each day of continued violation a separate offense.
