Summary

Kootenai County's land use code does not permit a private boat dock itself; that requires a separate Idaho Department of Lands permit. Instead LUDC 8.4.1410 tightly controls what can be built on the shoreline parcel serving the dock: one accessory storage building of 2,000 square feet or less, plus limited decks, walkways, stairways and trams.

These county ordinances apply to unincorporated areas of Kootenai County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

A. Notwithstanding any other provision of this title to the contrary, the uses permitted on dock lots shall be limited to the following: 1. One (1) personal storage building of two thousand (2,000) square feet or less in size shall be permitted of right regardless of parcel size. Such buildings may include a toilet and sink, but shall not otherwise include habitable space. Disposal of wastewater and sewage shall comply with the applicable requirements of Panhandle Health District. 2. Decks, walkways, stairways, stairway landings and trams, as permitted in section 8.4.1106 of this chapter and section 8.7.109 of this title. B. Access to a dock lot may be from the water only, or may also be from a road, driveway or common driveway. C. Outdoor storage shall be consistent with the recreational use of the parcel, or with ongoing construction of a structure on the parcel.

Full Breakdown

104 defines a dock lot as a shoreline parcel on a lake or river that derives its value primarily from riparian rights, including eligibility for a dock permit issued by the Idaho Department of Lands, the state agency that actually authorizes the dock structure over the water. 1410. 109. The storage building may include a toilet and sink but no other habitable space, and any wastewater or sewage from it must meet Panhandle Health District requirements. Subsection B allows access to a dock lot from the water only, or from a road, driveway or common driveway, recognizing that many Lake Coeur d'Alene dock lots are reached only by boat.

Subsection C limits outdoor storage on the lot to what is consistent with its recreational use or with an active construction project. 1410 is limited to what can be built on the upland lot that serves the dock.

Violations & Fines

Building anything beyond the one permitted 2,000-square-foot storage structure and the listed decks, walkways, stairways and trams on a dock lot exceeds LUDC 8.4.1410(A) and is enforceable by the Community Development Department as a zoning violation; storage or outdoor use inconsistent with the parcel's recreational or construction purpose violates subsection C. Building or altering the dock itself without the required Idaho Department of Lands permit is a separate state-level violation the county code does not waive.

Frequently Asked Questions

Does Kootenai County issue the permit for my boat dock?
No. LUDC 8.9.104 defines a dock lot's value as including eligibility for a dock permit issued by the Idaho Department of Lands, the state agency with jurisdiction over structures on the water. The county's own rule, LUDC 8.4.1410, only controls what can be built on the upland parcel serving the dock.
What can I build on a Lake Coeur d'Alene dock lot?
Just one accessory storage building of 2,000 square feet or less, which may include a toilet and sink, plus decks, walkways, stairways, stairway landings and trams built to the standards in 8.4.1106 and 8.7.109, under LUDC 8.4.1410(A).
Can I access my dock lot only by boat?
Yes. LUDC 8.4.1410(B) allows access to a dock lot from the water only, or from a road, driveway or common driveway, so a lot with no road frontage of its own is still a legally usable dock lot under the county's rule.
Can I store equipment or materials on a dock lot?
Only if it matches the lot's recreational use or an active construction project. LUDC 8.4.1410(C) limits outdoor storage on a dock lot to that purpose, and wastewater from the lot's one permitted storage building must separately meet Panhandle Health District disposal standards.
