Summary

Unincorporated McHenry County requires a stormwater management permit before building a boat dock on the Fox River, Chain O'Lakes or any other regulated waterway. Docks qualify for the streamlined General Permit Number 1 in County Code § 17.60.030 only if they stay within strict size limits enforced by the county's Stormwater Management Enforcement Officer.

These county ordinances apply to unincorporated areas of McHenry County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

i. Minor non-commercial boat docks – To be authorized by this General Permit Number 1, construction of minor non-commercial boat docks shall meet the following criteria. (1) The boat dock shall not project more than 50 feet into a waterway, and in no instance greater than ¼ of the width of the waterway. (2) The width of the boat dock shall not be greater than 10 feet. (3) For L-shaped or T-shaped docks, the length of that portion parallel to the shoreline shall not exceed 50% of the landowner's shoreline frontage, nor be greater than 50 feet in length. (4) Docks shall be aligned so as not to cross the straight-line projection of property lines into the waterway or come within 10 feet of the straight-line projection of the property line.

Full Breakdown

030(A) creates General Permit Number 1 for routine, small-footprint work in flood hazard areas, and subsection (A)(3)(i) sets the rules for minor non-commercial boat docks. A dock cannot project more than 50 feet into a waterway, and never more than one-quarter of the waterway's width. Width is capped at 10 feet. On an L-shaped or T-shaped dock, the leg running parallel to the shoreline cannot exceed 50% of the owner's shoreline frontage or 50 feet, whichever is smaller. Docks must be aligned so they do not cross the straight-line extension of a neighboring property line into the water, and must stay at least 10 feet from that line.

Attached shore stations and boat lifts follow the same alignment rule. The general permit covers the dock structure itself only: no accessory roofs or elevated decks are authorized under it. To use General Permit Number 1, the owner (or someone with written owner authorization) files a stormwater management permit application with the Enforcement Officer before construction starts, describing the project, attaching any required federal, state or local approvals, and paying the permit fee. If the project does not fit the general permit's terms, the Enforcement Officer directs the applicant to apply for an individual stormwater management permit instead, which carries its own review.

Violations & Fines

Building or altering a dock without the required permit, or outside the terms of an issued permit, violates § 17.60.090. Each offense carries a fine up to $750, with a minimum of $100 plus court costs on any guilty finding, and each day the violation continues counts as a separate offense. The Enforcement Officer can also revoke an issued permit, order the dock removed or the site restored to its prior condition, or require the owner to apply for an after-the-fact permit covering the unauthorized work.

Frequently Asked Questions

Do I need a permit to build a boat dock in unincorporated McHenry County?
Yes. County Code § 17.60.030 requires a stormwater management permit before construction. A dock that meets the size limits for minor non-commercial boat docks can use the streamlined General Permit Number 1; anything larger needs an individual permit with fuller review.
How far can my dock stick out into the water?
No more than 50 feet, and never more than one-quarter of the waterway's width, whichever is less, under § 17.60.030(A)(3)(i). The dock also cannot be wider than 10 feet.
Can my dock cross my neighbor's property line into the water?
No. The code requires the dock to stay clear of the straight-line extension of adjoining property lines and to remain at least 10 feet from that line, so alignment with the shoreline frontage matters before you build.
What happens if I build a dock without county approval?
You are subject to § 17.60.090: a fine up to $750 per day the violation continues, a $100 minimum on any guilty finding, possible permit revocation, and an order to restore the site or apply for an after-the-fact permit.
