East Baton Rouge Parish requires a Stormwater Pollution Prevention Plan (SWPPP) for all land-disturbing construction activity. UDC Chapter 15, Sections 15.14 and 15.16, and Title 2 Chapter 8 Section 2:362 mandate erosion and sediment controls on construction sites.
City-Parish Code of Ordinances Title 2, Chapter 8, Section 2:362 (Construction Site Stormwater/Erosion Prevention) requires all development activities to submit a SWPPP to the Department of Development. The SWPPP must specify best management practices (BMPs) to retain sediment on site, minimize exposed soil, and control pollutant discharges. UDC Chapter 15 Sections 15.14 (Drainage) and 15.16 (Water Quality) and Appendix K (Stormwater BMPs) further govern drainage impacts and require a Stormwater BMP Maintenance Covenant recorded with the Parish Clerk of Court. State permits LAR100000 (>5 acres) and LAR200000 (1β5 acres) from Louisiana DEQ are also required. Sites under one acre are exempt from the state permit but remain subject to local SWPPP requirements.
Violations of Section 2:362 and UDC Chapter 15 stormwater requirements may result in stop-work orders, fines, and LDEQ enforcement actions. Federal Clean Water Act consent decrees can impose additional penalties.
