Summary

Jefferson County requires new and substantially improved structures in mapped flood zones to elevate the lowest floor three feet above base flood elevation, or floodproof non-residential buildings to that height, under Section 405.060(B)(1) of the county's Flood Damage Prevention chapter.

These county ordinances apply to unincorporated areas of Jefferson County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

Residential Construction. New construction or substantial improvement of any residential structures, including manufactured homes, shall have the lowest floor, including basement, elevated to three (3) feet above base flood elevation. The elevation of the lowest floor shall be certified by a Missouri licensed land surveyor, engineer, or architect. Non-Residential Construction. New construction or substantial improvement of any commercial, industrial, or other non-residential structures, shall have the lowest floor, including basement, elevated to three (3) feet above the base flood elevation or, together with attendant utility and sanitary facilities, be floodproofed so that below the base flood elevation the structure is watertight with walls substantially impermeable to the passage of water and with structural components having the capability of resisting hydrostatic and hydrodynamic loads and effects of buoyancy.

Full Breakdown

060(A)(2). 060(B)(1)(a) requires that new construction or substantial improvement of any residential structure, including manufactured homes, have its lowest floor, including any basement, elevated to three feet above base flood elevation, three feet more than the FEMA-mapped base flood elevation itself, a freeboard buffer built into the local ordinance. 050(C)(7). 060(B)(1)(b) allows the same three-foot-above-base-flood-elevation standard, or, as an alternative, dry floodproofing so the structure is watertight below the base flood elevation with walls substantially impermeable to water and structural components able to resist hydrostatic and hydrodynamic loads and buoyancy; a Missouri registered professional engineer or architect must certify that standard is met.

060(B)(1)(c) further requires enclosures below the lowest floor used for parking, building access or storage to have flood openings equalizing hydrostatic pressure, at least two openings totaling one square inch of net area per square foot of enclosed area, with the bottom of each opening no higher than one foot above grade.

Violations & Fines

A structure built without the certified three-foot freeboard, or without the alternative dry-floodproofing certification for non-residential buildings, does not satisfy Section 405.060(B) and cannot receive final approval on its floodplain development permit; Section 405.050(C)(7)-(8) requires the Director to verify and keep a record of the actual certified elevation or floodproofing level before the permit process is considered complete.

Frequently Asked Questions

How high above base flood elevation must a Jefferson County home be built?
Three feet. Section 405.060(B)(1)(a) requires the lowest floor, including any basement, of new or substantially improved residential structures to be elevated to three feet above base flood elevation, certified by a Missouri licensed surveyor, engineer, or architect.
Can a commercial building be floodproofed instead of elevated in Jefferson County?
Yes. Section 405.060(B)(1)(b) allows non-residential structures to either elevate three feet above base flood elevation or use dry floodproofing certified by a Missouri registered engineer or architect as watertight below that elevation.
Are enclosed areas below an elevated home regulated too?
Yes. Section 405.060(B)(1)(c) requires enclosed areas below the lowest floor used for parking or storage to have flood openings totaling at least one square inch per square foot of enclosed area, with opening bottoms no higher than one foot above grade.
