Summary

Jefferson County can block subdivision of any land lying within a stream's floodplain outright: Section 10.20(b)(6) lets the Director of Roads and Transportation/County Engineer prohibit the subdivision when necessary for public health, safety or welfare, and bars clearing, grading or dumping in preserved floodplain areas except at the Director's own discretion.

City-specific rules exist: Hoover, Vestavia Hills, and Birmingham have their own flood zones rules that differ from Jefferson County's county-level regulations. If you live in one of those cities, check the city-specific page instead.

6. Flood Plain District. The Director of Roads and Transportation/County Engineer may when he deems it necessary for the health, safety, or welfare of the present and future population of the area and when necessary to the conservation of water, drainage, and sanitary facilities, prohibit the subdivision of any portion of the property which lies within the flood plain of any stream or drainage course. These flood plain areas shall be preserved from any and all destruction or damage resulting from clearing, grading, or dumping of earth, waste material, or stumps, except at the discretion of the Director of Roads and Transportation/County Engineer.

Full Breakdown

20 of the Subdivision and Construction Regulations. It gives the Director of Roads and Transportation/County Engineer authority to prohibit subdividing any portion of property lying within the flood plain of a stream or drainage course, exercised when the Director deems it necessary for the health, safety or welfare of present and future residents, or necessary for conserving water, drainage and sanitary facilities. Once an area is treated as protected under this authority, it must be preserved from destruction or damage caused by clearing, grading or dumping earth, waste material or stumps, except when the Director specifically allows it.

The Zoning Regulations' definitions article separately defines "Floodplain District" as a district delineated by Federal Flood Insurance Program floodplain and floodway boundary maps and documents, subject to inundation. The county's Flood Hazard Appeal Board, established September 19, 2006 with the Floodplain Management Ordinance, hears variance requests tied to that ordinance's Article 5, but the ordinance's own permitted-use and permit standards for development inside mapped flood zones are not in this file: the Floodplain Regulations and Floodplain Ordinance exist on the county's records only as scanned images without a searchable text layer.

This subdivision-stage prohibition therefore governs whether a parcel can be platted at all in a floodplain, while the separate, currently unreadable ordinance would govern permitting for construction once platted. The rule applies only to unincorporated Jefferson County.

Violations & Fines

Subdividing floodplain property without the Director's consent, or clearing, grading or dumping earth, waste material or stumps in a protected floodplain area without the Director's discretion allowing it, violates Section 10.20(b)(6) and can result in the Director withholding or revoking subdivision approval for the property. The section does not itself list a separate fine schedule; enforcement runs through the plat-approval process rather than a standalone citation.

Frequently Asked Questions

Can Jefferson County stop a subdivision inside a floodplain?
Yes. Section 10.20(b)(6) of the Subdivision and Construction Regulations lets the Director of Roads and Transportation/County Engineer prohibit subdividing property that lies within a stream or drainage course's floodplain when necessary for health, safety, welfare, or the conservation of drainage and sanitary facilities.
Is grading or dumping allowed in a Jefferson County floodplain area?
Only if the Director of Roads and Transportation/County Engineer specifically permits it. Section 10.20(b)(6) otherwise requires floodplain areas be preserved from destruction or damage caused by clearing, grading or dumping earth, waste material or stumps.
Where are Jefferson County's detailed floodplain development standards?
They sit in the county's Floodplain Management Ordinance, adopted September 19, 2006, and the county's flood maps, both of which exist on file only as scanned images without extractable text, so their specific permitted-use and permit terms cannot be quoted from this source yet.
