Unincorporated Solano County operates under a Phase II NPDES Small MS4 stormwater permit from the State Water Resources Control Board. Any construction or grading project that creates 2,500 square feet or more of impervious surface in the unincorporated county must obtain a grading permit under Solano County Code Chapter 31, which incorporates NPDES stormwater requirements including a Storm Water Pollution Prevention Plan (SWPPP) for larger sites.
Solano County's stormwater program is implemented by Resource Management β Public Works to comply with the federal Clean Water Act, the California Porter-Cologne Water Quality Control Act, and the State Water Board's Phase II Small MS4 General Permit (Order No. 2013-0001-DWQ as amended). Post-construction, certain new and redevelopment projects must include Low Impact Development (LID) features such as bioretention, infiltration trenches, or pervious pavement to manage runoff onsite. The MS4 permit also prohibits non-stormwater discharges to the County storm-drain system: car-washing soap, paint, motor oil, pet waste, pool drainage, and similar contaminants may not enter gutters, catch basins, or roadside ditches.
Discharging pollutants to the storm-drain system, or failing to install and maintain required BMPs at a construction site, can result in a stop-work order from Solano County Public Works, additional inspection fees, and referral to the San Francisco Bay or Central Valley Regional Water Quality Control Board for civil penalties β which under the Clean Water Act can reach $10,000 per day per violation or more. Continuing violations may also be cited as misdemeanors under the general penalty provision of Solano County Code Chapter 1.
