Summary

Chatham County's Storm Water Management Ordinance, Sec. 24-708, makes it unlawful to dump trash, landscape debris or other material into any stream, channel, ditch or storm water facility, or to alter, obstruct or tamper with the county's drainage system without the Director's written authorization. The ordinance applies countywide under Sec. 24-705.

These county ordinances apply to unincorporated areas of Chatham County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

1. It shall be unlawful to dump, deposit, or otherwise cause any trash, landscape debris, or other material to be placed in any stream, channel, ditch, or any portion of the storm water management facilities. ... 4. It shall be unlawful for any person to maliciously, willfully, or negligently break, damage, destroy, uncover, deface, modify, or tamper with any storm water structure, appurtenance, or equipment. 5. It shall be unlawful, without prior written authorization of the Director, to alter in any way any part of the storm water system including, but not limited to, rerouting, removing, deepening, widening, enlarging, filling or obstructing any part of the storm water system including fencing over or across lands encumbered by drainage easements and rights-of-way which render the system unaccessible to equipment necessary to perform maintenance and repairs.

Full Breakdown

Sec. 24-705 applies the Storm Water Management Ordinance throughout Chatham County, including drainage systems the county maintains under intergovernmental agreements with municipalities, and puts the Department in charge of the county's MS4, its municipal separate storm sewer system, and of carrying out the storm water program required under the county's NPDES permit. Sec. 24-708's prohibition list follows: dumping trash, landscape debris or other material into any stream, channel, ditch or storm water facility is unlawful outright, as is tampering with, damaging, or defacing any storm water structure or equipment, or altering, rerouting, deepening, widening, enlarging, filling or obstructing any part of the system without the Director's prior written authorization, including fencing across a drainage easement in a way that blocks maintenance access.

A short list of discharges is exempted: water line flushing by a government agency, unpolluted groundwater, foundation drains, air conditioning condensate, irrigation and lawn watering runoff, and firefighting flows. Anyone responsible for an accidental discharge into the county's MS4 must notify the Department within two hours and take immediate steps to contain it. Sec. 24-710 makes property owners responsible for maintaining any private storm water facility serving their own lot, and larger development is separately required under Sec. 2 inches of rainfall and remove 80 percent of the average annual sediment load before discharge.

Violations & Fines

Dumping into a stream or storm drain, tampering with storm water infrastructure, or altering the drainage system without the Director's written authorization violates Sec. 24-708. Under Sec. 24-713, a willful or negligent violation draws a $500-per-day financial penalty plus possible imprisonment, and the County Board Chairman can separately pursue a civil penalty for damage to public storm water facilities, with the Director's assessment appealable through a written petition and hearing.

Frequently Asked Questions

Can I dump yard debris in a ditch in Chatham County?
No. Sec. 24-708(1) makes it unlawful to dump trash, landscape debris, or other material into any stream, channel, ditch, or storm water management facility anywhere in the county. The Director can except limited unpolluted discharges like lawn watering runoff and foundation drains, but not general debris.
Who is responsible for maintaining a private drainage pond in Chatham County?
Sec. 24-710 places any storm water facility or best management practice serving a single residential, commercial or industrial lot in the property owner's hands; the owner must maintain it privately, and alterations still need the Director's prior written authorization under Sec. 24-708(5).
What is the penalty for violating Chatham County's storm water ordinance?
Sec. 24-713 sets a $500-per-day financial penalty for a willful or negligent violation, plus possible imprisonment, and allows the County Board Chairman to pursue a separate civil penalty for damage to public storm water facilities, assessed by the Director and appealable through a written petition and hearing.
