Springdale Chapter 107 (Revised September 2017) governs stormwater discharges, illicit connections, grading, and erosion control under the city's NPDES Phase II MS4 permit administered through ADEQ Construction Permit ARR 150000. Any project disturbing 0.5 acre or more requires a city grading permit and an approved Stormwater Pollution Prevention Plan (SWP3).
Chapter 107 of the Springdale Code is administered by the Director of Engineering and implements the federal Clean Water Act (33 U.S.C. 1251 et seq.) and the NPDES Phase II MS4 stormwater program through the Arkansas Department of Environmental Quality (now part of ADEQ within Arkansas Energy & Environment). Section 107.3.B requires an approved SWP3 for any construction site disturbing 0.5 acre or more, and Section 107.3.F requires a grading permit, with fees of $250 for 0.5 to 1 acre and $500 for 1 acre or greater. Grading plans must conform to ADEQ Construction Permit ARR 150000. The chapter prohibits illicit discharges and illicit connections to the MS4 (Sec. 107.2.A and 107.7.E), and Section 107.7.E.1 expressly allows certain exempt discharges such as dechlorinated swimming-pool water and lawn irrigation. Riparian buffers of 25 feet from named streams and 50 feet from TMDL-listed waters must be preserved (Sec. 107.1.D and 107.3.F.9.o).
Discharging anything other than uncontaminated stormwater to the MS4, building an illicit connection, or grading 0.5 acre or more without an approved SWP3 and grading permit violates Chapter 107. Section 107.4.I sets a fine schedule of $500/day for a first offense, escalating to $4,000/day for fourth and subsequent offenses, plus stop-work orders and recovery of abatement costs.
