South Fulton fences must be set back at least 3 feet from a public right-of-way, with a 3-foot landscape strip between the fence and the right-of-way (Zoning Ord. Sec. 406.02(c)(6) and (c)(8)). Fences may not obstruct the required sight-distance triangle.
Beyond the 8-foot height cap, South Fulton's Zoning Ordinance Sec. 406.02 sets placement and design requirements. Sec. 406.02(c)(8) requires fences and walls to be set back a minimum of 3 feet from a public right-of-way, and Sec. 406.02(c)(6) requires a minimum 3-foot landscape strip between a fence or wall and a public right-of-way. Sec. 406.02(a) requires fences, walls, and associated vegetation to not obstruct the minimum sight-distance requirements specified in the Subdivision Regulations, and gates must remain 20 feet off the right-of-way (Sec. 406.02(b)). Where the ordinance or zoning conditions require a solid/opaque fence, Sec. 406.02(c) requires the visual density to be such that it cannot be seen through. Fences and walls are allowed within required yards (Sec. 403.03(d)(1)) and may be placed along side and rear lot lines interior to required single-family zoning buffers (Sec. 405(d)). The use of fabric as a fence or screen is prohibited except as a windscreen around recreational courts (Sec. 406.02(c)(5)). Agricultural fences in AG-1 are exempt from permit requirements but remain subject to the material and sight-distance rules.
Zoning enforcement by CDRA: fences placed in the right-of-way or 3-foot landscape strip, or obstructing sight distance, may require relocation; civil penalties for non-conforming installations.
