Under Sec. 6-3003 and Table 1, the maximum allowable sound measured at the receiving property line drops at night. For residential or noise-sensitive properties Sunday through Thursday night, limits fall to 70 dB within 50 feet and 50 dB beyond 300 feet; Friday and Saturday nights allow 75 dB within 50 feet. The code also bars mechanical sound devices, shouting, and party noise that is plainly audible beyond the distances in Table 1. The city council directs in Sec. 6-3003(e) that the times be interpreted to provide maximum protection from undesirable noise. Enforcement is by city ordinance citation under Sec. 6-3008, with escalating minimum fines for repeat violations.
Violations are prosecuted by city ordinance citation under Sec. 6-3008. The minimum fine is $200 for a first conviction, not less than $500 for a second conviction within 12 months, and not less than $1,000 for a third conviction within 24 months, plus any additional penalty the municipal court imposes.
