South Fulton restricts construction and demolition to daytime hours. Work is prohibited 7:00 p.m.-7:00 a.m. on weekdays, before 9:00 a.m. or after 5:00 p.m. on Saturday, and at any time on Sunday, unless it qualifies as emergency work or meets the landscaping power-tool standard.
Under Sec. 6-3005(2) of South Fulton's noise code (Ord. No. 2018-010), construction and demolition activity 'shall not be performed between the hours of 7:00 p.m. and 7:00 a.m. on weekdays, before the hour of 9:00 a.m. or after the hour of 5:00 p.m. on Saturday, or at any time on Sunday.' Two exceptions apply: the activity is deemed emergency work, or it meets the limits set for landscaping power tools in Sec. 6-3005(1). The code defines 'construction' in Sec. 6-3002 as any site preparation, assembly, erection, repair, alteration, similar action, or demolition of buildings or structures. The chief of police may grant relief: if the loss or inconvenience to a party in interest warrants special consideration, the chief may issue a renewable permit not to exceed ten days allowing work within the hours of 10:00 p.m. to 7:00 a.m. The general sound-level limits in Table 1 (Sec. 6-3003) and the special-variance process in Sec. 6-3007 also remain available. Violations are enforced by city ordinance citation under Sec. 6-3008.
Construction outside permitted hours is enforced by citation under Sec. 6-3008. Minimum fines escalate from $200 (first conviction) to not less than $500 (second within 12 months) to not less than $1,000 (third within 24 months), in addition to any other penalty. The court may order immediate abatement of the activity.
