Amplified music rules in South Fulton, GA โ also called sound permit, PA system, or live music ordinances โ set decibel limits, time-of-day restrictions, and when permits are required.
South Fulton makes it unlawful to operate radios, stereos, instruments, amplifiers, or other sound devices so loudly that they are plainly audible beyond the distances in Table 1, or past the property boundary. The Table 1 decibel limits by zone, distance, and time also apply.
South Fulton's noise code regulates amplified sound through both a decibel standard and a plainly-audible standard. Sec. 6-3003(b)(1) makes it unlawful to play or operate 'any radio receiving device, television, stereo, musical instrument, phonograph, sound, amplifier, or other machines or devices producing, reproducing or amplifying sound' at a volume that creates noises plainly audible at or beyond the distances in Sec. 6-3003(a) from the building, structure, or motor vehicle, or, if the property line is farther, beyond that property boundary. Sec. 6-3003(b)(3) separately addresses party noise, making the person in charge responsible when a party or social event is plainly audible beyond the Table 1 distances or property limits. The underlying decibel caps come from Table 1 in Sec. 6-3003(a): for example, residential daytime allows 80 dB within 50 feet stepping down to 55 dB beyond 300 feet, with lower limits at night. Municipally sponsored or approved events are exempt under Sec. 6-3004(a), and permitted amplified-sound events under an approved special administrative permit are exempt under Sec. 6-3004(b)(8). Enforcement is by citation under Sec. 6-3008.
Amplified-music violations are prosecuted by citation under Sec. 6-3008, with minimum fines of $200 (first), $500 (second within 12 months), and $1,000 (third within 24 months). A third conviction within 24 months can also trigger automatic suspension of an alcohol license for a restaurant or late-night establishment, plus revocation proceedings.
