Section 138-3702 of Chapter 138 governs fences and walls in unincorporated Pinellas County. In residential zoning districts, fences and walls within the side and rear setback areas may rise up to six feet for any standard style or eight feet for decorative styles along secondary arterial and collector frontages. Inside the required front-yard setback, fences cannot exceed three feet, although a semi-opaque decorative topper may add height up to a combined five-foot total. Rural residential districts allow split-rail fences up to six feet in front setbacks if at least 50 percent transparent. Heights are measured from the lowest adjacent grade to the uppermost horizontal member, and fences placed atop retaining walls count the wall in the total unless three feet of horizontal separation is provided.
Code enforcement may issue notices of violation, require fence shortening or removal, and impose daily civil penalties through the Pinellas County Code Enforcement Board until the height violation is corrected.
