Summary

Volusia County limits residential fences to six feet in side and rear yards, four feet in front yards, and three feet on the rearward portion of atypical lots. Corner-lot fences must also clear the county's traffic-visibility standard. Chain link, wood and vinyl fences on single-family lots may go up without a separate fence permit.

City-specific rules exist: Deltona, Port Orange, and Daytona Beach have their own height limits rules that differ from Volusia County's county-level regulations. If you live in one of those cities, check the city-specific page instead.

a.Fences, walls and hedges, except those with an opacity of 25 percent or less erected only to meet the minimum safety requirements of the Florida Building Code, as amended, shall not exceed three feet in height when erected on an atypical lot rearward of the rearmost point of the principal structure as defined by the required yard area. Fences, walls and hedges in all other rear and side yards shall not exceed six feet in height.b.Except as provided in subsection 72-284(2), fences, walls or hedges in a front yard shall not exceed four feet in height; however, on corner lots also refer to subsection 72-277(a)(8) for obstruction to visibility.

Full Breakdown

Section 72-282 of the county's land planning code sets the yard-by-yard height ceiling for every residential fence, wall or hedge in unincorporated Volusia. In side and rear yards the limit is six feet; on an atypical lot, any fence rearward of the back of the house drops to three feet unless it has 25 percent or greater opacity and is built only to meet Florida Building Code safety rails. Front yards are capped at four feet, and on corner lots that front-yard fence is also subject to the vision-obstruction rule in section 72-277(a)(8), which bars any fence, wall or hedge from blocking a motorist's sightline at an intersection under Article III, Division 4 of the Land Development Code.

Retaining walls and any fence mounted on top of one are held to the same height ceilings, measured from existing grade on both sides of the wall. Nonresidential fences may run up to eight feet around a project perimeter if they don't obstruct traffic visibility, and residential subdivision entry walls may reach six feet with traffic-engineer sign-off. Height is measured from natural grade with a two-inch ground-clearance allowance. Homeowners on corner lots, through lots or unopened platted rights-of-way who want to exceed the front-yard limit can apply for an administrative variance under section 72-379(5)e, capped at a two-foot increase to a six-foot maximum, provided the second front yard functions as a side or rear yard with no driveway access.

Violations & Fines

Fences and walls in unincorporated Volusia are enforced by the county's zoning enforcement official through the code enforcement process in Chapter 1. A first violation carries a fine up to $500 and up to 60 days in jail under section 1-7, while the code enforcement board can separately impose civil fines up to $1,000 per day for a first offense and $5,000 per day for a repeat violation, plus liens recorded against the property.

Frequently Asked Questions

How tall can my backyard fence be in unincorporated Volusia County?
Up to six feet in a standard side or rear yard under section 72-282(1)a. If your lot is atypical and the fence sits behind the rear-most point of your house, the limit drops to three feet unless it has at least 25 percent opacity and only meets Florida Building Code safety-rail requirements, in which case the six-foot standard still applies.
Do I need extra clearance for a fence on a corner lot?
Front-yard fences are capped at four feet, but section 72-277(a)(8) also bars any fence on a corner lot from blocking a driver's sightline. If you need more height because a second front yard functions as your side or rear yard, you can apply for an administrative variance under section 72-379(5)e, capped at six feet total.
How is fence height measured?
Section 72-282(9) measures height from the existing natural grade along the outside of the required yard, and where a fence sits on a slope with varying elevations, the height is checked from grade on both sides. The section allows a two-inch ground-clearance gap at the bottom to be factored into the calculation.
Are the rules different for a business or subdivision entrance fence?
Yes. A nonresidential fence, wall or hedge may reach eight feet around a project's perimeter as long as it doesn't block traffic visibility at access points, and chain-link used there must be vinyl-coated black. A residential subdivision's entry or project wall is capped at six feet, subject to the traffic engineer confirming no sightline conflict.
