In unincorporated Elko County, Nevada, Elko County Code § 4-8-8 caps a fence, wall or hedge at six feet and at three and one-half feet in a required front yard, a corner lot's required street side yard, or the rear yard part that abuts a key lot's required front yard.

These county ordinances apply to unincorporated areas of Elko County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

(A) Fences, Walls and Hedges: Fences, walls and hedges as regulated herein may occupy any yard area. Except as otherwise provided, no fence, wall or hedge shall have a height in excess of six feet (6'). No fence, wall or hedge in a required front yard, in the required street side yard of a corner lot or in that part of the rear yard or a corner lot which abuts the required front yard of a key lot shall have a height in excess of three and one-half feet (31/2'). The term "wall" as used in this Section shall not be deemed to apply to the wall of a building or to the supporting portion of a retaining wall. ... A protective fence enclosing any public property or an open area for games or a swimming pool shall not be subject to said limitations, if constructed of wire or steel mesh capable of transmitting at least ninety percent (90%) light. (C) Measurement of Height: The height of a fence, wall or hedge shall be measured from the finished level of the ground beneath it on the premises required to provide it.

Full Breakdown

Elko County Code § 4-8-8(A) lets fences, walls and hedges occupy any yard area in unincorporated Elko County, Nevada, and sets two height limits. Except as otherwise provided, no fence, wall or hedge can exceed six feet. In a required front yard, in the required street side yard of a corner lot, or in that part of the rear yard of a corner lot which abuts the required front yard of a key lot, the limit drops to three and one-half feet. The section controls corner lots through the street side yard limit. The word "wall" does not cover the wall of a building or the supporting portion of a retaining wall.

The required yard depths come from the district chapters. In an R1 district, § 4-3-2(E) requires a front yard of 20 feet, a rear yard of 20 feet, a side yard of 10 feet along the street lot line of a corner lot, and 5 feet along an interior side lot line, so the three and one-half foot limit applies inside those distances.

Subsection (B) lists exceptions. The height limits do not apply where a greater height is required by another ordinance, allowed by a variance, or specified in connection with a conditional use. A protective fence enclosing public property, an open area for games or a swimming pool is not subject to the limits if it is built of wire or steel mesh capable of transmitting at least ninety percent light.

Subsection (C) says height is measured from the finished level of the ground beneath the fence on the premises required to provide it. Where a fence or hedge rises directly above a retaining wall along a lot line, or above, parallel with and within four feet of such a wall, the permitted height of a fence not required by the title is reduced by one-half the height of the supporting portion of the retaining wall, but never to less than three feet.

An employee decision under the zoning title can be appealed in writing to the Planning Commission within ten days under § 4-9-3. The cities of Elko, Carlin, Wells and West Wendover have their own fence rules.

Violations & Fines

A fence that violates the zoning title is unlawful and declared a public nuisance under § 4-9-14(A). Violating the title is a misdemeanor punishable by a fine of not more than $1,000, up to six months in jail, or both, and each day is a separate offense. The Planning and Zoning code enforcement officer can issue a warning or written citation.

Frequently Asked Questions

How tall can a fence be in unincorporated Elko County?
Elko County Code § 4-8-8(A) says no fence, wall or hedge can exceed six feet except as otherwise provided. In a required front yard, in the required street side yard of a corner lot, or in the part of a corner lot's rear yard abutting a key lot's required front yard, the limit is three and one-half feet.
How is fence height measured?
Section 4-8-8(C) measures height from the finished level of the ground beneath the fence on the premises required to provide it. If the fence rises above a retaining wall, or sits parallel with and within four feet of one, the allowed height drops by one-half the retaining wall's supporting height, but never below three feet.
Are there exceptions to the height limit?
Section 4-8-8(B) lifts the limits where another ordinance requires a greater height, or a variance or conditional use allows it. A protective fence around public property, an open game area or a swimming pool is also exempt if it is wire or steel mesh that transmits at least ninety percent light.
Does the corner lot rule use a sight triangle?
The fence section does not print a sight triangle. Corner lots are handled by the three and one-half foot limit in the required street side yard and in the rear yard part that abuts a key lot's required front yard. In an R1 district the street side yard along a corner lot's street lot line is 10 feet under § 4-3-2(E).
