A fence over the printed height, or one built without the permit required by § 1137.15(E), is a Zoning Code violation. The Building Inspector sends the owner a written notice naming the violation and how to correct it. Under § 1127.99, a violation is a fourth-degree misdemeanor, fined not more than $250.00, up to thirty days in jail, or both, and each day is a separate offense. A repeat within one year is a third-degree misdemeanor, up to $500.00.
