Kirkland Zoning Code Section 115.40 governs fence height. Fences not exceeding 6 feet in height may be placed anywhere on the subject property, except within 15 feet of a street curb (or the edge of the pavement if no curb exists). Within that 15-foot street-vision zone, taller sections are not permitted. Properties that abut a neighborhood access or collector street (designated in the Kirkland Transportation Master Plan) may not have a fence over 3.5 feet in height within the front yard setback. The combined height of a fence and a retaining wall within 5 feet of each other in a required yard is capped at 6 feet total; stepping the wall and fence apart by more than 5 feet allows each to be evaluated separately. Fences located outside required setback yards may not exceed the maximum structure height established for the zone in which the fence is located (usually 30 feet). Within sight-distance triangles at intersections and driveways, a 30-inch height limit applies regardless of overall code to preserve driver visibility.
Over-height fences are civil violations under KZC 115.40 with notice of correction requiring removal or height reduction within 30 days; continued noncompliance escalates fines through KMC 1.12 enforcement.
