Little Chute Code of Ordinances Sec. 44-394 (Chapter 44, Zoning) regulates fences in the Village. Within the required 25-foot front yard setback, no fence may exceed 42 inches in height; on corner lots this restriction applies to both yards adjacent to the streets. Behind the front yard setback, fences may not exceed 6 feet in total measured height. A 4-foot (48-inch) fence is permitted in the front setback if it has a 50% see-through design. Fences must sit along (but not straddle) the lot line, and electrified, barbed wire, and razor wire fences are prohibited in residential areas. Chapter 44 of the Little Chute Code of Ordinances is the Village's Zoning Code, adopted under Wis. Stat. Sec. 61.35 (which extends Sec. 62.23 city planning powers to villages). Sec. 44-394 governs fences as accessory uses. In residential districts, no fence located within the required 25-foot front yard setback may exceed 42 inches (3.5 feet) in height; on corner lots, this 42-inch limit applies to both yards facing a street. A taller fence of 48 inches (4 feet) may be installed in the front setback only if it features a 50% see-through (open) design to preserve sight lines. Behind the front setback line, residential fences may reach a maximum measured height of 6 feet. Fences must be located along the lot line but may not straddle it (must be entirely on the owner's property). The finished/decorative side of the fence is required to face the adjoining property. Prohibited materials include unsightly or dangerous materials that constitute a nuisance; electrified fences, barbed wire, and razor wire are not permitted in residential areas. Ordinance No. 06 and No. 08 of 2023 amended Sec. 44-394(c) addressing fence and hedge height. A fence permit is required from the Village Community Development Department before installation, and a site plan showing fence location, height, and materials must accompany the application. Wisconsin partition-fence statutes (Wis. Stat. Chapter 90, including Sec. 90.03) also apply to shared boundary fences between adjoining property owners.
Constructing or maintaining a fence in excess of the Sec. 44-394 height limits, without the required Village fence permit, with prohibited materials (electrified, barbed wire, razor wire in residential), or that straddles the lot line can trigger municipal forfeitures and an order to remove or modify the fence. Enforcement is handled through the Village Community Development Department; unresolved violations are referred for citation and processed through Outagamie or Calumet County Circuit Court depending on parcel location.
