In unincorporated Shasta County, fences, walls, and hedges within any required front yard or within any side yard on the street side of a corner lot are capped at 3 feet. Shasta County Code Section 17.84.030 (Height limits-exceptions), subsection A (Fences), sets the maximum height of any fence, wall, hedge, screen planting, or other dividing structure in residential and commercial districts. Under subsection A(1), the limit within any required front yard or within any side yard on the street side of a corner lot is 3 feet. Under subsection A(2), the limit is 6 feet in any rear yard or in any required interior side yard not subject to A(1); a fence may exceed this height only if a use permit is first secured. Subsection A(3) carves out an important exception: the height limits do not apply to open wire fencing material used as a fence or dividing structure, or placed atop any fence, wall or other dividing structure. Under subsection B(4), a residential accessory structure, building, or fence may also be erected above the district height limit if an administrative permit is issued; for all other over-height fences, a use permit is required (see Section 17.92.020).
Building a fence that exceeds 3 feet in the front yard or street-side corner-lot side yard, or that exceeds 6 feet in a residential rear/side yard, without an administrative or use permit, is a Zoning Code violation. The Code Enforcement Division may issue a notice of violation and require height reduction or removal of the offending portion. Continued violation can lead to administrative civil penalties under the Shasta County Code, including daily fines and abatement of the structure as a public nuisance.
