Full Breakdown

Section 108-7-3 of the Land Use Code sets three height tiers. A wall, fence or hedge up to four feet tall can go anywhere on a lot, subject only to the corner clear-view rules in Section 108-7-7. Step up to six feet, and placement narrows: on an interior lot, a six-foot fence can go anywhere except inside the required front setback; on a corner lot, it can't sit inside either the front setback or the side setback that faces the street. 030's clear-view triangle, which at a street intersection runs 40 feet back along each right-of-way line from the corner, with the two lines connected to form the triangle; nothing over three feet tall, including trees, walls or fences, may obstruct cross-visibility inside that triangle between two and eight feet off the ground.

Along the Ogden Canyon corridor, the code adds a highway-safety limit on top of the general rules: no fence taller than four feet may stand within 50 feet of the centerline of Highway 39. The code exempts fences that state law requires around public utility subdivisions and public schools from these local height caps entirely. Residential subdivisions can also be ringed by a perimeter fence up to six feet tall, but only with design review approval and only where lot access still comes from the interior public or private streets inside the project.

Violations & Fines

An oversized or improperly placed fence is a Land Use Code violation under Section 102-4-4, punishable as a class C misdemeanor or civil penalty, with each day of noncompliance a separate offense. The code enforcement official must serve written notice giving the owner 14 days to bring the fence into compliance before escalating to administrative citations of $100, $200, then $400 per violation per day, followed by court-ordered abatement and a lien for unpaid fines.
