Full Breakdown

Sec. 22-302 defines a privacy fence as any fence that is opaque and cannot be readily seen through. Rear yards may generally be enclosed by a privacy fence without special permission, at the heights set in Sec. 22-303(c). But on an interior lot, Sec. 22-304(a)(2) says a side yard fence between the rear and front building lines can only be a privacy fence if the adjoining neighbor gives written consent, and no fence at all may go in the side yard of lots with adjacent or abutting driveways without mutual consent of the owners.

Violations & Fines

A side yard privacy fence built on an interior lot without the neighbor's written consent can be cited by the building department and ordered removed or relocated.
