Where screening is required to be a solid fence or wall, alternative materials may be substituted by adjustment, except that a solid fence or wall must be used where screening is required adjacent to a residential use or category. Chain-link fencing with slats and landscaping may be substituted for a solid wall or fence in an Industrial category, except where screening or fencing is required adjacent to another land use category. Landscaped berms may substitute for a wall or fence provided the combination of berm and landscaping is not less than the required height. Section 23.04.190 mirrors these provisions in the Coastal Zone. The County code does not impose a county-wide ban on barbed wire on agricultural and rural properties (where it is the customary livestock-fencing material), but residential and commercial fencing must comply with material standards in 22.10.080.
Using a non-conforming material where the ordinance requires a specific type (e.g., installing chain-link with slats adjacent to a residential category where a solid wall is required) is a zoning violation. The Director may order removal, replacement with conforming material, or require a Minor Use Permit adjustment. Continuing violations are subject to County Code general penalty and nuisance-abatement remedies.
