A fence may sit on the lot line, but no part (including the footing) may cross onto a neighbor's property or right-of-way. The finished side must face the adjoining lot, though the county can waive that if the neighbor already has a fence or hedge.
LDC Section 5.03.02 B allows a fence or wall on the lot line but prohibits any protrusion, including the foundation, onto adjacent property or the right-of-way. Section 5.03.02 F.5 requires the finished side face the adjoining lot or any abutting right-of-way. If the neighboring parcel already has a fence, wall, or continuous landscape hedge, the finished-side requirement may be administratively waived by the County Manager or designee. Collier County does not mandate cost-sharing between neighbors; a shared boundary fence is a private civil matter. Locating the fence entirely on your side of the line avoids encroachment disputes.
An encroaching fence can be ordered removed or relocated and may prompt a private civil trespass claim. Code Enforcement can cite finished-side and boundary violations under LDC 5.03.02.
