Ohio has no Good Neighbor Fence statute for residential property. Under ORC 971 the partition-fence law applies only to agricultural lands. Each residential property owner in Franklin County is responsible for their own fence unless a written agreement exists.
ORC 971.02 through 971.09 allows agricultural landowners to petition the township trustees to compel a neighbor to share costs of a line fence when used for livestock. This does not apply to suburban residential lots. For residential disputes, the spite-fence common-law doctrine allows a lawsuit when a fence exceeding 6 feet is built maliciously to annoy a neighbor. Franklin County Municipal Court handles small claims for fence-damage disputes up to 6,000 dollars.
