The Lake County UDO addresses neighbor-adjacent fencing chiefly through easements. Property owners are responsible for removing and replacing fences, walls, and other structures placed within easements whenever the county or a utility provider needs access. Fences within drainage easements must not restrict overland stormwater flow, and at least 2 inches of clearance is required between the bottom of the fence and the ground below. Hedges and natural plantings follow the same location and height rules as fences. The UDO sets no 'finished-side-facing-neighbor' mandate; disputes over the exact boundary line or a shared (partition) fence are civil matters governed by Indiana state law, not the county zoning office.
A fence blocking a drainage easement or placed in a utility easement may be ordered removed at the owner's expense; continued zoning noncompliance is a nuisance per se subject to citation penalties up to $2,500/$7,500 under IC 36-1-3-8.
