Per Yuba County Development Code Section 11.19.040(H), fences over seven feet in height require a building permit. Retaining walls over four feet (bottom of footing to top of wall) or subject to surcharge require a grading permit under Section 11.23.020. Most standard residential fences within height limits need no permit.
The Development Code ties fence permitting to height and construction. Section 11.19.040(A) notes walls and fences may require a building permit depending on height, and subsection (H) states plainly that fences over seven (7) feet in height shall require a Building Permit. Fences within the standard height allowances are generally exempt from building permits, though they must still meet the height, setback, materials and visibility standards of Section 11.19.040. Separately, retaining walls are regulated under the grading provisions: Section 11.23.020(A)(2)(a) requires a grading permit for retaining walls over four feet in height (measured from bottom of footing to top of wall) or any retaining wall subject to surcharge. Walls and fences in non-residential districts (excluding Natural Resource and Agricultural districts) are further regulated by the County's Design Guidelines. Where a proposed fence exceeds allowed heights or encroaches into a required setback, Section 11.19.040(I) allows a Waiver or variance permitting up to one foot of additional height and up to a 20 percent reduction of the required yard/setback when the design fits the neighborhood character. Apply through the Community Development and Services Agency.
Building or grading without a required permit is a violation enforced by the Yuba County Community Development and Services Agency. Unpermitted fences and retaining walls may have to be removed or brought into compliance.
