The City of Denton enforces pool barrier requirements through its adopted building codes and Texas Health and Safety Code Chapter 757. Residential swimming pools, hot tubs, and spas capable of holding 24 inches or more of water must be enclosed by a barrier at least 48 inches in height measured from the exterior side. Gates must be self-closing and self-latching, with latches placed at least 54 inches above grade on the exterior or equipped with a key lock. The barrier must not have openings, handholds, or footholds that would allow a child to climb through or over. Horizontal rail spacing must not exceed 1.75 inches; vertical pickets must be spaced no more than 4 inches apart. Chain link fences used as pool barriers must have openings no larger than 1.75 inches. The house wall may serve as one side of the barrier if all doors opening to the pool area have self-closing devices and alarms meeting UL 2017 standards. Above-ground pools with walls 48 inches or higher may serve as their own barrier if the ladder is removable or lockable. A pool barrier inspection is required before the pool is filled and before a final certificate of compliance is issued.
