Des Plaines requires all swimming pools deeper than 24 inches to be enclosed by a barrier at least 48 inches high with self-closing, self-latching gates, in compliance with the International Swimming Pool and Spa Code and Illinois Department of Public Health rules.
Under the building code adopted by Des Plaines, all in-ground and above-ground swimming pools, hot tubs, and spas with water depth over 24 inches must be enclosed by a barrier at least 4 feet (48 inches) high. Gates must be self-closing and self-latching, with the latch located at least 54 inches above the ground or on the pool side of the gate. Above-ground pools may use the pool wall as part of the barrier if the wall is at least 48 inches high and the ladder is removable or lockable when not in use. Door alarms or pool covers may be required where a house wall serves as part of the barrier. Building permits for pools include barrier inspection. Contact CED at (847) 391-5380.
Pool barrier violations may result in fines of $100 to $750 per day until corrected, plus orders to drain the pool until compliant. Liability for drowning incidents may be severe.
