Nevada NRS 461A and Henderson Municipal Code require a barrier at least 5 feet high around residential pools and spas, with self-closing and self-latching gates and a latch at least 54 inches high.
Nevada Revised Statutes Chapter 461A (Pool and Spa Safety) and Henderson Municipal Code Title 15 adopting the International Swimming Pool and Spa Code require every private outdoor swimming pool, spa, or hot tub capable of holding 24 inches or more of water to be completely enclosed by a barrier at least 5 feet tall. Access gates must be self-closing and self-latching, open outward away from the pool, and have the release mechanism on the pool side at least 54 inches above the ground. Vertical barrier openings cannot exceed 4 inches and there cannot be a gap at the bottom greater than 2 inches. Where a wall of the home serves as part of the barrier, all doors leading to the pool must have an audible alarm or the pool must have a power safety cover or other approved compliant system. Henderson Building and Fire Safety inspects pool barriers at final pool permit inspection. Nevada has among the highest per-capita child drowning rates and enforcement is aggressive.
Noncompliant pool barrier: failed inspection, stop-use order, daily fines, liability exposure under NRS 461A. Drowning incident: potential criminal charges and civil suit.
