The Fort Bend County Regulations for Swimming Pools, Spas, and Aquatic Recreational Facilities require pools serving HOAs, apartments, motels, schools, and similar semi-public uses in unincorporated areas to be enclosed by a barrier at least 48 inches high with openings no wider than four inches and self-closing, self-latching gates. Private pools controlled by an owner of a single-family residence or duplex serving no more than two families are expressly exempt. The Environmental Health Department permits and inspects covered pools annually before opening.
Operating a regulated semi-public pool without a compliant barrier or required permit can result in permit denial, suspension, closure of the facility, and misdemeanor penalties under Texas Health and Safety Code authority adopted by the county.
