Residential pools deeper than 24 inches in Winston-Salem need a 48-inch fence with self-closing, self-latching gates. NC State Building Code governs pool barriers. All pools require permits.
Winston-Salem follows the NC State Building Code, which adopts the International Residential Code Appendix G pool barrier requirements. All residential swimming pools, spas, and hot tubs deeper than 24 inches must have a barrier at least 48 inches high measured from the outside. Gates must open outward away from the pool, be self-closing and self-latching, with the latch at least 54 inches above the ground. Openings in the barrier cannot allow passage of a 4-inch sphere. If the house wall forms part of the barrier, doors leading to the pool must have alarms or a power safety cover per code. Above-ground pools with walls 48 inches or taller may qualify as their own barrier if the ladder is removable or lockable. Permits are required from the Inspections Division before construction.
Construction without permit or barrier: stop-work order and 500 dollar penalty. Failure to maintain barrier: code enforcement and fines up to 500 dollars.
