Volusia County Land Development Code and the Florida Building Code (FBC 8th Edition) Section 1807 govern retaining walls. Walls 4 feet or less from footing bottom to top with no surcharge typically do not require a permit. Walls exceeding 4 feet, or any wall supporting a surcharge (driveway, structure, sloped fill above), require a building permit with engineered plans sealed by a Florida-licensed professional engineer. In coastal areas (Daytona Beach, Ormond Beach, NSB, Ponce Inlet), walls within the Coastal Construction Control Line must also comply with FL Β§161.053 and DEP review. Volusia's flat coastal topography plus SJRWMD (St. Johns River Water Management District) drainage requirements mean most walls need engineered drainage (weep holes, gravel backfill, filter fabric). Setbacks from property lines generally 3-5 feet for walls over 4 feet. Sea turtle nesting zones impose additional restrictions on coastal retaining structures under FL Β§161.163.
Unpermitted retaining walls over 4 ft: stop-work order, after-the-fact permit with double fees, and potential demolition if unsafe. Fines $200-$1,000 per Volusia County Code. Coastal violations under FL Β§161.053 carry higher penalties up to $10,000.
