Under San Jose Municipal Code § 24.02.120(A)(5), a building permit is not required for retaining walls up to 4 feet tall, measured from the bottom of the footing to the top of the wall, unless the wall supports a surcharge or holds back Class I, II or III-A liquids. But permit exemption doesn't mean unregulated: Table 20-70 in Municipal Code § 20.30.500, governing accessory buildings and structures in residential zoning districts, caps retaining wall height at just 2 feet measured from existing grade. A taller wall needs a Special Use Permit under Chapter 20.100, Part 7. Retaining walls carry no required front setback under the same table.
