Summary

Retaining walls in Stearns County's Shoreland Overlay District need a shoreland alteration permit under Ordinance 439 Section 10.2.14.I before they can be built. Wall height is measured from ground level to the top of the wall, and any wall or series of walls exceeding four feet in cumulative height on a bluff or steep slope needs a plan signed by a Minnesota licensed professional engineer.

These county ordinances apply to unincorporated areas of Stearns County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

I. Retaining Walls. The construction of retaining walls are subject to the requirements in Section 10.2.14B and D of this Ordinance and shall only be authorized by either a minor or major shoreland alteration permit. Wall height as it pertains to this Section is measured from the ground surface to the top of the wall. Wall components below grade shall not be included in wall height determination. Cumulative height means the combined height of any wall or series of walls require to retain a single slope. ... (2) Major Shoreland Alteration Permit. Retaining walls proposed on bluffs or on steep slopes within the shore impact zone may only be authorized by a major shoreland alteration permit when the following apply: (a) Retaining walls may be allowed where there is a demonstrated need, the design is consistent with the existing uses in the area, and there is not an aesthetic intrusion upon the land or the shoreline. (b) No wall(s) shall exceed four (4) feet in height without a plan signed by a Minnesota licensed professional engineer.

Full Breakdown

B and D, and requires either a minor or major permit before a wall goes in. The ordinance defines wall height as measured from the ground surface to the top of the wall, excluding any below-grade wall components, and defines cumulative height as the combined height of any wall or series of walls needed to retain a single slope. A Minor Shoreland Alteration Permit covers smaller walls: those four feet or less in cumulative height where a documented erosion problem exists, walls not visible from the shore due to topography or vegetation, approved replacement walls, ornamental or terracing walls of four feet or less confined to one area no larger than 25% of lot width and no more than 75 feet wide, and walls sited outside the applicable lake or river class setback.

Walls proposed on bluffs or steep slopes within the shore impact zone, or any wall exceeding those minor-permit thresholds, need a Major Shoreland Alteration Permit issued by the County Board, granted only where there is a demonstrated need, a design consistent with the area's existing uses, and no aesthetic intrusion on the land or shoreline. Critically, no wall may exceed four feet in height without a plan signed by a Minnesota licensed professional engineer. The Department may also require inspections during grading, vegetation removal, and installation of stormwater and erosion controls, and can demand a financial guarantee of 125% of grading and erosion-control costs on major permits.

Violations & Fines

Owners may appeal an enforcement finding to the Board of Adjustment and then District Court within 30 days.
