Full Breakdown
Sacramento County Code § 4.50.130 bars anyone from using public or private property, a facility, or a residence in the unincorporated county for a "motion picture production" without a valid Special Business License issued under Chapter 4.10 and Article 3 of Chapter 4.50. The Article defines "motion picture production" broadly under § 4.50.115 as any activity attendant to staging, filming or videotaping commercial motion pictures, television shows, programs or advertising; "still photography" is defined separately in § 4.50.120 and is exempt from licensing.
The County Treasurer-Tax Collector administers the license (§ 4.50.125), holding the same authority the Sheriff exercises over other Special Business Licenses under Chapter 4.10. Once an applicant files a complete application, the Treasurer-Tax Collector must send copies to the Sheriff, the chief of any fire protection district with jurisdiction over the filming location, and any other affected official, each of whom has 30 calendar days to submit written findings on public-safety conditions or resource needs (§ 4.50.140). Notwithstanding the general licensing timeline in § 4.10.040, the Treasurer-Tax Collector must act on the application within 30 calendar days of filing and must issue the license unless the Director of Public Works, the Sheriff, or a fire district chief finds in writing that the production would create a public safety hazard that no condition could eliminate (§ 4.50.145).
Section 4.50.135 exempts four categories from the license requirement: news reporters, photographers or camera operators covering on-the-spot news events for a newspaper, news service or television station; any production filmed at a studio located in the unincorporated county; commercial still photography; and advertising productions by tenants at Sacramento Metropolitan Airport that have the Airport Director's advance written approval (if the Director refuses, the license requirement applies).
Violations & Fines
Operating without the required license is a misdemeanor once the county serves written notice of the violation and orders it stopped, under County Code § 1.01.190; the Sheriff, the Director of Finance and other enforcing officials, including Business License Inspectors, can arrest without a warrant for the offense. A denied or conditioned license can be appealed through the Chapter 4.10 hearing process before the conditions or denial take effect.
