DeSoto Chapter 42 (Nuisances) and Chapter 38 (Fire) require property owners to keep grass below 12 inches, clear combustible brush within 30 feet of structures, and maintain defensible space on lots over 1/2 acre.
Under Section 42-91 of the DeSoto Code, it is a public nuisance to allow weeds or grass to exceed 12 inches in height or to accumulate combustible debris. On properties of 0.5 acre or more, and particularly those near the Briarwood Park greenbelt or undeveloped tracts, owners must maintain a 30-foot defensible-space zone around any structure: remove dead vegetation, trim tree limbs 6 feet from the ground, and store firewood at least 30 feet from structures. The city issues a 10-day Notice of Violation; failure to comply triggers abatement by the city with costs liened to the property under Tex. Health & Safety Code Β§342.006.
